This general information and practice guide reflects our experience from previous work on planning, coastal legislation, protected sites and tourism disputes along the Marmaris, Mu\u011fla, Bodrum, Didim, Sel\u00e7uk, \u00c7e\u015fme, Urla, Milas, Fethiye, Akyaka, Ula, Ka\u015f, Kalkan and Kemer coastline.<\/p>\n

1. Why can one coastal tourism investment lead to several legal proceedings?<\/h3>\n

A beach club in Bodrum, a hotel in Marmaris, a seaside restaurant in \u00c7e\u015fme or Ala\u00e7at\u0131, a boutique hotel in Urla or a holiday rental villa in Fethiye or Kalkan does not operate on the basis of a single permit. Planning status, a building permit, an occupancy permit, a business opening and operating licence, tourism certification, coastal legislation, protected or conservation status and, sometimes, allocation or lease rights can all intersect in the same investment.<\/p>\n

Consequently, assumptions such as \u201cI have a permit, so the building cannot be demolished\u201d or \u201cI have a tourism operating certificate, so the municipality cannot seal the premises\u201d are not correct in every case. One lawful document does not automatically remedy a breach of another legal regime. Conversely, an allegation of non-compliance does not by itself make an administrative demolition order, fine, licence cancellation or closure lawful. Competence, form, grounds, subject matter and purpose must be reviewed alongside proportionality, the right to respond and service of notice.<\/p>\n

For valuable coastal property and tourism businesses, the key is to identify every administrative decision and establish how they relate. A stop-work record, municipal executive committee decision, planning fine, licence cancellation, sealing record and public prosecutor\u2019s investigation may arise from the same event while producing different consequences and time limits.<\/p>\n

A brief answer<\/h5>\n

If a villa, hotel, guesthouse, beach club, restaurant or tourism facility faces demolition or sealing, first review all served documents together with the approved architectural project, permits, occupancy certificate, title and allocation records, coastal boundary map, conservation decisions and photographs.<\/p>\n

Filing an administrative action does not automatically suspend the decision. Where the conditions exist, a stay of execution must be requested separately and supported by concrete grounds. If a criminal investigation has begun, technical findings in the administrative file do not automatically establish criminal responsibility.<\/p>\n

3. Stop-work records and demolition under Planning Law No. 3194<\/h3>\n

Article 32 of Planning Law No. 3194 provides for sealing and stopping construction when a structure is found to have no permit or to breach its permit and annexes. Posting the stop-work record at the site may constitute service on the person responsible for the building; the record must also be sent to the relevant administration. Where obtaining a permit or remedying the breach is possible within the statutory process, this should be documented. Otherwise, the municipal executive committee or competent administrative authority may order demolition.\u00b9<\/p>\n

A stop-work record is more than an ordinary site note. It should clearly identify the affected part, dimensions, floor area, effects on the structural system and nature of the departure from the permit or project. Abstract wording such as \u201cconstruction contrary to the permit exists\u201d can create serious disputes about calculation of the fine, the scope of demolition and the right of defence.<\/p>\n

The unlawful part may be an enclosed terrace, a jetty connection, pergola, kitchen extension, pool surround, basement use or a platform extending towards the beach rather than the whole hotel. A decision covering the entire facility instead of the non-compliant part must also be assessed for proportionality and subject matter. In many cases, the extent of the breach and whether it can be remedied cannot reliably be established without technical expert examination.<\/p>\n

4. Which errors should be examined when challenging a planning fine?<\/h3>\n

An administrative fine under Article 42 is a separate decision from a demolition order. Challenging demolition does not automatically remove the fine; challenging only the fine does not automatically suspend demolition. Check the service date and subject of each decision separately.<\/p>\n
